Terms and Conditions

These Terms and Conditions govern your access to and use of the DUUXS platform, including the website and applications, and apply to all users of the platform.

By accessing or using DUUXS, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use the platform.

DUUXS is operated by DUUXS Pty Ltd, an Australian company. References to “DUUXS”, “we”, “us”, or “our” refer to DUUXS Pty Ltd.

DUUXS operates an online marketplace that enables Explorers to connect with independent Hosts offering Experiences.

DUUXS does not provide Experiences and is not a party to any agreement between a Host and an Explorer. Any booking results in a direct agreement between the Host and the Explorer, and the Host is solely responsible for delivering the Experience.

DUUXS acts only as an intermediary providing access to the platform and related tools, and does not act as an agent, employer, partner, or representative of any Host or Explorer.

You may browse the DUUXS platform without creating an account. To request or accept bookings, you must register an account and provide accurate, current, and complete information.

You may only create one account and are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.

DUUXS may suspend or restrict access to the platform where an account is used in breach of these Terms, including misuse of the platform, unauthorised access, or interference with platform functionality.

You must be at least 18 years old to create an account or book an Experience.

Explorers may request bookings for Experiences offered by Hosts through the DUUXS platform. Hosts may accept or decline booking requests at their discretion.

A booking is confirmed only when it has been accepted by the Host and appears in the Explorer`s account on the platform. DUUXS may also provide electronic confirmation by email or notification.

DUUXS does not offer instant confirmation, and Hosts may communicate with Explorers before accepting a booking.

Hosts are expected to honour confirmed bookings and communicate promptly if changes or cancellations are unavoidable.

Explorers are expected to attend confirmed bookings or notify Hosts if they are unable to do so.

DUUXS does not process payments for Experiences. Any payment for an Experience, if required, is arranged directly between the Host and the Explorer and occurs outside the DUUXS platform.

Hosts may charge for Experiences, request donations, or offer Experiences free of charge, as agreed with the Explorer. DUUXS charges Hosts a subscription fee for access to the platform and does not charge commissions on bookings.

Hosts are solely responsible for determining and complying with any tax obligations arising from their Experiences, including issuing invoices or receipts where required by law.

After an Experience, Hosts and Explorers may rate each other using a five-star rating system and may provide written feedback.

By submitting a rating or review, you grant DUUXS a non-exclusive, royalty-free licence to use, display, reproduce, and distribute that content in connection with the operation and promotion of the platform.

Reviews and ratings reflect the opinions of users and do not represent the views of DUUXS. DUUXS may remove or moderate reviews that breach these Terms.

DUUXS retains all intellectual property rights in the platform, including its design, software, content, and branding.

Users retain ownership of the content they provide to the platform. By uploading or submitting content, you grant DUUXS a non-exclusive, royalty-free licence to use that content for operating, displaying, and promoting the platform and related Experiences.

You acknowledge that participation in Experiences may involve inherent risks and that you participate at your own discretion and responsibility.

Hosts are responsible for conducting Experiences in a reasonable and responsible manner and for informing Explorers of any material risks associated with an Experience.

DUUXS does not provide insurance coverage for Experiences and is not responsible for the safety or conduct of Hosts or Explorers during an Experience.

Information on the DUUXS platform is provided on an “as is” and “as available” basis. While DUUXS takes reasonable care in operating the platform, it does not guarantee that content will be accurate, complete, current, or error-free.

DUUXS makes no warranties, express or implied, regarding the availability, reliability, or suitability of the platform or any Experiences offered by Hosts. Content provided by Hosts or Explorers does not constitute endorsements or representations by DUUXS.

To the extent permitted by law, DUUXS is not liable for any indirect, incidental, special, or consequential loss arising from your use of the platform or participation in an Experience.

You agree to indemnify and hold DUUXS harmless from claims, losses, or damages arising from your breach of these Terms, your use of the platform, or your participation in an Experience.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights that cannot be excluded under the Australian Consumer Law.

If you experience an issue relating to the DUUXS platform or an Experience, you should notify DUUXS as soon as reasonably practicable and cooperate in good faith to resolve the matter.

Complaints relating to an Experience should first be raised directly with the Host. DUUXS may, at its discretion, assist by facilitating communication between the parties but is not responsible for refunds or compensation for Experiences.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before commencing legal proceedings.

These Terms and Conditions are governed by the laws of Australia, and any proceedings must be brought exclusively in the courts of Hobart, Tasmania.

DUUXS collects, uses, and stores personal information in accordance with its Privacy Policy and applicable data protection laws.

By using the platform, you consent to the collection and use of your personal information as described in the Privacy Policy.

Explorers may request bookings for Experiences offered by Hosts and enter into direct agreements with Hosts when a booking is confirmed. DUUXS is not a party to those agreements.

Explorers are not required to make any upfront payment through the DUUXS platform. Any payment for an Experience is arranged directly with the Host.

Complaints relating to an Experience should be raised promptly with the Host. Where appropriate, DUUXS may assist by facilitating communication, but DUUXS is not responsible for refunds or compensation for Experiences.

By registering as a Host, you agree to offer Experiences as an independent service provider and to comply with these Terms and the DUUXS Host Code of Conduct.

Hosts are responsible for accurately representing their Experiences, communicating clearly with Explorers, and honouring confirmed bookings. Hosts must personally conduct Experiences and must not send substitutes.

Hosts are expected to act professionally and responsibly, including responding to booking requests in a timely manner and maintaining reasonable standards of reliability and conduct.

DUUXS may review Host performance from time to time, including feedback and ratings from Explorers, and may take action where Host conduct or performance falls below reasonable platform expectations.

Hosts are responsible for complying with all applicable laws, regulations, permits, and licensing requirements relevant to their Experiences.

DUUXS may suspend or terminate access to the platform, in whole or in part, where a user breaches these Terms or the applicable Code of Conduct. Suspension or termination may result in the cancellation of confirmed bookings.

DUUXS may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

Neither DUUXS nor users will be liable for failure or delay in performing obligations under these Terms where caused by events beyond reasonable control, including natural disasters, government actions, or other force majeure events.
